1. General. Participation in the competition is voluntary, free of charge and only possible under the conditions listed here. By participating, the participant expressly accepts these conditions of participation. All personal designations within these conditions of participation apply equally to persons of any gender.
   
   
2. Organizer. The organizer of the competition is PM Atelier GmbH, Sunneblick 29, 6343 Rotkreuz, Switzerland commercial register number: CHE-232.880.418, as the operator of the Instagram account @pm__atelier ("PM Atelier"). The competition is not connected to Instagram or Facebook and is in no way sponsored, endorsed or organized by Instagram or Facebook.
   
   
3. Advertising Partners. The competition may be posted by a third party such as influencers or brands (hereinafter "PM Atelier partner"). The PM Atelier partner is not itself the organizer of the competition.
   
   
4. No claim. There is no claim to participate in the competition. The participants are not entitled to a prize. PM Atelier reserves the right to cancel or end the competition at any time without prior notice and without giving reasons. PM Atelier reserves the right to change or correct the conditions of participation at any time.
   
   
5. Eligibility. All legally competent persons who have reached the age of majority in their country of residence are entitled to participate. Participation is not limited to existing PM Atelier customers and is not dependent on the purchase of any goods or services.
   
   
6. Restrictions on Participation. All persons and employees of PM Atelier involved in the conception and implementation of the competition as well as their family members are not entitled to participate in the competition.
   
   
7. Exclusion from Participation. The organizer reserves the right, at its own discretion, to exclude persons from participation if there are legitimate reasons, for example (a) manipulations in connection with access to or implementation of the competition, (b) violations of these conditions of participation, (c) unfair behavior, or (d) providing false or misleading information in connection with participation in the competition.
   
   
8. Participation Requirements. Participation in the competition requires that the participant undertakes the following actions (cumulative):

• Like the giveaway post on Instagram
• Follow @pm__atelier on Instagram
• Tag a friend in the comments under the giveaway post. Every one comment equals one entry
  
• Bonus entry: Re-share the competition post to their story and tag @pm__atelier

9. Duration of the competition. The competition begins on August 7, 2024 CET and ends on August 20, 2024, at 11:59 p.m. CET.
   
   
10. Win. The prize is described on the online page of the competition and is listed again below.

The prize is the following:

• 1x 80 CHF PM Atelier voucher

11. Determination of Winner. The winner will be determined at random after the end of the implementation period under exclusion of the public.
    
    
12. Delivery of prize. The winner will be informed via Instagram direct message. The winner will be provided with a discount code with the value stated above (paragraph 10). There is no obligation to accept the prize. Exchange, collection, cash payment or transfer of the prize is not possible. The winner is responsible for paying taxes on the prize.
13. Prize in kind. Any prize in kind will be sent to the winner.
    
    
14. Voucher. Any prize voucher will be sent to the winner after the contact details have been sent. The voucher can be redeemed in the PM Atelier online shop. Voucher is valid for 3 months from the date the winner is revealed.
    
    
15. Data processing. According to Art. 6 (1) lit. a DSGVO, personal data will be collected and processed with your consent to the extent necessary in each case if you participate in one of our Instagram competitions. The data entries required for participation in the competition (following, liking, commenting, tagging) are governed by the Instagram privacy policy. In the event of a win, we will ask you to provide us with your data required for the prize draw, in particular contact and booking data, account data. We require your data for the purpose of determining the winner as well as for issuing the prize, in particular, dispatch, booking, reimbursement, etc. Until the end of the participation period, you can object to the processing of your data at any time and thus revoke your participation in a competition by deleting the data entered on Instagram. From the end of the participation period, you can object to the processing of your data at any time and thus revoke your participation in the draw by sending us an email to contact (at) pm-atelier.com. In this case, your data will be deleted immediately. Please note that in this case you will no longer be able to participate in the competition and receive any prizes and if you were the winner, a replacement winner will be drawn. We will only store your data for the duration of the competition, provided that there are no legal retention periods to the contrary and we have no justified interest in continuing to store it.
    
    
16. Responsibility of Participants. The participant assures that he will not infringe any rights of third parties when participating in the competition. PM Atelier has no influence on and bears no responsibility for the actions of the participants.
    
    
17. Limitation of liability. In the case of intent or gross negligence, PM Atelier is liable according to the statutory law. In the event of simple negligence, PM Atelier is only liable in accordance with the statutory provisions

• for damage resulting from injury to life, body or health,
• for damages resulting from the not insignificant breach of an essential contractual obligation (i.e. an obligation, the fulfillment of which enables the proper execution of the contract in the first place and on the compliance of which the participant regularly trusts and may rely); in this case PM Atelier’s liability is limited to the compensation of the foreseeable, typically occurring damage.

The limitations of liability do not apply in the case of fraudulent intent or the assumption of a guarantee. Liability under the Product Liability Act remains unaffected. The limitations of liability also apply to breaches of duty by or in favor of PM Atelier's representatives and vicarious agents. Unless expressly stipulated otherwise above, PM Atelier's liability is excluded.

18. Applicable Law and Jurisdiction. The law of Switzerland shall apply. If the participant acts as a consumer and has his habitual residence in a country other than Switzerland, the application of mandatory legal provisions of this country remains unaffected by the prior choice of law. If the participant acts as a consumer and does not have a general place of jurisdiction in Switzerland, moves his domicile or usual place of residence outside of Switzerland after the competition or the domicile or usual place of residence of the participant is not known at the time of a lawsuit, the exclusive place of jurisdiction shall be at the seat of PM Atelier. Apart from that, the place of local and international jurisdiction shall be governed by applicable statutory provisions.
